GENERAL CONDITIONS OF SALE

1 – GENERAL PROVISIONS

These provisions are valid only for Francesco Arduini P.iva: 03209570609 REA Number: FR-313128 – Registered and Operational Office: Via Cervona, 29, Torrice, 03020 (FR) – Mail: info@francescoarduini.com henceforth referred to as “ARDUINI” and any person who undertakes a business relationship on this site by subscribing referred to henceforth as “CUSTOMER”. These conditions may be subject to change, and the date they are posted on the site is equivalent to the effective date. These conditions govern purchases made on www.francescoarduini.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree. n. 206/2005, as amended by Leg. n. 21/2014 and by Leg. 70/2003 on electronic commerce.

2 – OBJECT OF THE CONTRACT

By these general conditions of sale, ARDUINI sells and CUSTOMER purchases at a distance the tangible goods indicated and offered for sale on www.francescoarduini.com. The contract is concluded exclusively through the Internet, by means of the CUSTOMER accessing www.francescoarduini.com and placing a purchase order in accordance with the procedure provided by the website itself. The customer undertakes to read, before proceeding to the confirmation of his order, these general conditions of sale, in particular the pre-contractual information provided by ARDUINI and to accept them by placing a flag in the box indicated. In the order confirmation e-mail, the CUSTOMER will also receive the link to download and file a copy of these general terms and conditions, as provided in Art. 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

3 – PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER

The CUSTOMER, prior to the conclusion of the purchase contract, shall take note of the characteristics of the goods, which are illustrated in the individual product sheets at the time of selection by the CUSTOMER. Before the validation of the order with “obligation to pay”, the CUSTOMER is informed regarding:

– Total price of goods including taxes, with details of any other costs;
– method of payment;
– conditions, terms and procedures for exercising the right of withdrawal (Article 6 of these conditions) as well as type of withdrawal form in Annex I, Part B of Legislative Decree 21/2014;
– After-sales service conditions and commercial guarantees provided by ARDUINI.

The CUSTOMER may at any time and in any case before the conclusion of the contract, take cognizance of the information about ARDUINI, the geographical address, e-mail address, information that is shown, including at the top of this page.

4 – CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The contract of sale is considered concluded with the sending by ARDUINI to the CUSTOMER of an e-mail confirming the order. The e-mail contains the CUSTOMER’s information and order number, the price of the goods purchased, and the link to be able to print and file a copy of these conditions. The CUSTOMER agrees to verify the accuracy of the personal data contained in the above email and to promptly notify ARDUINI of any corrections/changes to be made. ARDUINI undertakes to deliver the goods within 30 days commencing from the sending by the customer of the payment and its receipt by ARDUINI.

5 – METHOD OF PAYMENT

Accepted payment methods are bank transfer, paypal, credit cards, debit cards. Data are provided at the time of order completion.

6 – RIGHT OF WITHDRAWAL

The CUSTOMER who intends to exercise the right of withdrawal must notify ARDUINI by e-mail: commerciale@francescoarduini.com. The customer is required to return the goods within 7 days from the date of delivery of the goods.
The risks and costs associated with the return are the responsibility of the customer and are not refundable in any way. ARDUINI will refund the customer within 14 days after delivery of the return.
Only the value of the goods excluding shipping costs will be refunded. ANY BREAKAGE OR DAMAGE TO THE GOODS SHIPPED MUST BE REPORTED UPON RECEIPT OF THE GOODS FOR THE RETURN TO BE MADE. Goods should be shipped to the address: Via Cervona 29, Torrice (FR), 03020. Upon receipt of the goods, the company will evaluate the goods, which must be returned undamaged, in the original packaging, complete in all its parts (including packaging and any documentation and ancillary equipment). In addition, a sheet with the customer’s first and last name, order number, reason for return and iban should be included.

7 – SITE ACCESS

The CUSTOMER has the right to access the site for browsing and making purchases. No other use, particularly commercial, of the site or its content is permitted. The integrity of the elements of this site, whether aural or visual, and the related technology used remain the property of ARDUINI and are protected by intellectual property law.

8 – INTEGRITY

These General Terms and Conditions of Sale consist of the entirety of their component clauses. If one or more of the provisions of these Terms and Conditions is deemed invalid or declared invalid under law, regulation, or following a decision by a court having jurisdiction, the other provisions shall continue in full force and effect.

9 – RESPONSIBILITY

ARDUINI assumes no liability for inefficiencies attributable to force majeure or fortuitous events, even where dependent on malfunctions and failures of the Internet network, in the event that it fails to execute the order within the time stipulated in the contract.

10 – APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are subject to Italian law. Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of the Frosinone forum. In any case, you may optionally have recourse to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale by accessing the following site:https://webgate.ec.europa.eu/odr. Reference is made to the Frosinone forum for any confirmation.
